  • IT IS A PLACE WHERE POWER IMBALANCES CAN BE ADDRESSED;
  • IT DOES NOT TAKE THE PLACE OF INDEPENDENT LEGAL ADVICE;
  • IT MAY HELP TO IMPROVE RELATIONS AND COMMUNCIATIONS.

MEDIATOR ROLES:

  • A FACILITATOR;
  • A MANAGER OF THE PROCESS;
  • AN INFORMATION GATHERER;
  • AN INFORMATION PROVIDER;
  • A REALITY TESTER;
  • A SCRIBE.

WHAT ARE THE ROLES IN MEDIATION?

  • YOU ARE RESPONSIBLE FOR MAKING THE DECISIONS ABOUT THE CONTENT AND OUTCOME;
  • THE MEDIATOR MANAGES THE PROCESS;
  • THE MEDIATOR MAKES THE ADMINISTRATIVE AND PRACTICAL ARRANGEMENTS
  • THE MEDIATOR MANAGES THE MEETING IN A SAFE AND CONSTRUCTIVE WAY
  • THE MEDIATOR IDENTIFIES, UPDATES AND IMPLEMENTS THE AGENDA YOU SET.
  • THE MEDIATOR KEEPS YOUR SOLICOTOR IN THE LOOP SO THAT THEY CAN FEED IN TIMELY AND RELEVANT LEGAL ADVICE TO SUPPOR THE MEDIATION PROCESS.

FAMILY MEDIATION CAN BE DEFINED AS A PROCESS IN WHICH:

A couple or any other family members:

  • Whether or not they are legally represented;
  • And at any time, whether or not there are or have been legal proceedings;
  • Agree to appoint a neutral third party (the mediator);
  • Who is impartial;
  • Who has no authority to make decisions with regard to their issues;
  • Which may relate to separation, divorce, children, property and financial questions, or any issues they may raise;
  • But who helps them reach their own informed decisions;
  • By negotiation;
